Dodge 1500 struck by swerving Utility Vehicle
Facts: On August 11, 2008, Plaintiffs were driving a Dodge 1500 in the center lane on US 290 in Houston, Texas. Defendant was in an International 4700 utility vehicle in an adjacent lane on US 290. Without warning the defendant’s vehicle swerved into the Plaintiffs’ Lane and violently struck the back of the Plaintiffs’ vehicle.During litigation, it was discovered that defendant would been able to avoid the collision if he had been abiding by the four-second rule for following distance that is advised by TXDOT’s driving manual. It was also found that defendant had virtually no experience operating an International 4700 utility vehicle before being hired by his employer
Injuries: Plaintiff suffered serious injuries in the collision. He was diagnosed with bulging discs at L4-5, and a herniated disc at L5-S1. After extensive therapy, Plaintiff underwent lumbar surgery to fuse both L4-5, and L5-S1. This included the insertion of screws into his lower back.
Damages: Plaintiffs’ Medical Expenses exceeded $300,000.00Result:
