Front End Loader Enters Roadway without Warning and Strikes Plaintiffs’ Vehicle.
Facts: On June 10, 2010, a front-end loader driven by Defendant and owned by Defendant’s employer was traveling on Light Company Road near the intersection with Lawndale Street. Defendant failed to yield to the traffic on Lawndale and entered the intersection, colliding with the vehicle driven by the Plaintiff. Plaintiff was driving westbound on Lawndale at the time of the collision with a belted front seat passenger. Defendant was cited for failing to yield the right of way.
Injuries: Plaintiff was seriously injured in the collision. She experienced severe neck pain radiating into her shoulders, arms and hands, low back pain radiating into her legs, headaches and arm numbness following the incident. Plaintiff was ultimately diagnosed with bulging discs at L4-5 and L5-S1, and a C5-6 disc rupture causing cord compression.
Plaintiff’s passenger was also injured. He suffered from neck pain radiating into both arms and causing headaches, and low back pain radiating into both legs. He was diagnosed with herniated discs at C3-C7 and L2-S1.
Damages: Plaintiffs’ combined Medical Expenses exceeded $160,000.00
